In these Terms and Conditions "we" and "us" mean World Market Enterprises ABN 47294751552 of Perth, Western Australia ,Australia, and "you" means you the customer
These Terms and Conditions together with your order constitute the entire contract between us and you for the supply of products. No other Terms and Conditions will apply. The contract cannot be varied .
Guarantee of Authenticity : All products sold on www.nobetaway.com are guranteed authentic. It is a crimnal offence to sell fake/ copied goods in Australia and as such we do not offer copied goods to our customers.
. We will not deliver to Nigeria, Indonesia, Israel, Iraq, Vietnam, Russia, Venezuala, Mexico or Columbia under any circumstances...
We will not deliver to a PO Box or Road side box under any circumstances.
Legal Capacity To Transact If you are under the age eighteen (18) years you can not place orders with nobetaway.com
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
Placing Your Order
By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions.
We will notify you that your order is being processed by sending you an Order Confirmation via email, however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing payment fraud. World Market Enterprises reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
If we cannot process or accept your Order after payment is received we will contact you by email .
Orders placed on a weekend or a public holiday will not begin payment processing until the next business day.
Business days are Monday through Friday, excluding W.A Public holidays.
Prices

GST:All watches are exclusive of GST. We will not issue false GST invoices when GST is not charged or collected by our business

To ensure the security of credit card payment we do not accept credit card details over the phone .
Fraud:
We take fraud very seriously. Any customer that attempts to defraud our company of goods and or money, will be reported to the relevant law enforecement agencies in thier country of residence. All details of the transaction and customer details will be passed on to the law enforecement agency for full investigation and our company will assist in ensuring that prescution occurs.
Supply Of Your Products: Subject to these Terms and Conditions, we will supply to you the products indicated on your order confirmation.
Delivery Of Your Products
Delivery time takes up to 10 " working " days from the date your payment is " cleared ". Special watch orders can take up to 8 weeks for delivery as they will be sourced from our international distributor. Please email us prior to purchasing a watch, to check availability and delivery time as we will not allow cancellations or refunds on orders whereby the customer has changed their mind due to the delivery time frame.
Failure to contact us prior to purchasing is seen as an acknowledgement that you are happy to wait up to 8 weeks for delivery. Adding a note to your order, stating a delivery time frame is not seen as an agreement to deliver within your time frame, but merely a perferred delivery time frame and as such we are not bound to deliver within the requested time..
nobetaway.com makes every effort to deliver your Product according to the estimated delivery times provided . The estimated delivery times are in business days (Monday through Friday) excluding Public holidays.
Although every effort is made to ship your Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your product has not arrived after the estimated delivery time, please contact us at sales@nobetaway.com
.Unless otherwise agreed by us, we will deliver your Products to the address indicated on your order confirmation. If no-one is available to take delivery of your Products, our carrier (Australia Post , Fedex, UPS or EMS)will leave a card so you can pick-up your Product from your local Post Office. .
www.nobetaway.com assume no responsibilty for items delivered to the incorrect address if the registration address or order confirmation address is incorrect.It is the customers obligation to provide the correct address.
We do not insure goods unless shipping insurance is purchased by the customer. p> Uninsured goods will be sent via parcel post ( no tracking number ). We take no responsibility for lost parcels that are not insured. The customer waves all rights to seek compensation of any kind for non delivery of uninsured goods.
Uninsured goods will be dispatched via regular air mail or parcel post and as such will not have tracking details attached.
Goods that are insured and deemed lost by the relevant courier are subject to a full refund or replacement ( excluding PO Box and Rooadside Box deliveries when requested by a customer ). We are not able to refund or replace any lost goods until the courier in question has completed all investigations and awarded compensation for the lost goods , to our business.
Goods requested to be sent to a PO Box will not be insured. The insurance costs paid by a customer requesting delivery to a PO Box are required cover the extra costs of receiving the product at our office, processing and forwarding to a PO Box ( our standard delivery costs calculated into the price will only cover delivery direct from our wholesaler to the customer and do not cover the cost of receiving at our office and forwarding postal costs to customers requesting delivery to a PO Box ). Customers that request delivery to a PO Box but do not pay insurance, will not have the item delivered until the extra payment is made to cover the order forwarding to a PO Box.
A customer that requires insured delivery to a PO Box must first contact our customer support to request that the insurance costs ( An extra 5% is added to the price to cover Australia Post insurance costs ) be added to the product price and a special listing be created for this request .
Your Rights To Return A Product
No refunds, credit or replacements are offered if you have changed your mind about the product, make an incorrect choice, or failed to verify and accurately provide information when placing an order.
Please ensure goods are as ordered before breaking the seal on the box . Once the seal is broken you have accepted the package as delivered ( model, colour etc ) and it can not be returned unless a product fault is noted
Dead On Arrival Products - "DOA"
A Product is considered DOA if it shows symptoms of a failure, or is discovered to be broken when first taken from its packaging.
A customer service member will provisionally determine whether the Product is DOA. Where a product is provisionally determined as DOA we will arrange a replacement.
Refunds will only be offered where a replacement product can not be provided.
Where we have provisionally determined that a product is DOA, return shipping will be arranged at no cost to the customer
When a Product is replaced, your replacement product becomes your property and the returned DOA product becomes our property.
When a refund is given, the returned DOA product becomes our property.
nobetaway.com reserves the right to test any returned DOA product. If the condition of the product was misrepresented by the customer, we will impose a 20% handling and administration fee , payable before the item is returned.
Product Problems After Delivery
If your item arrives DOA (Dead On Arrival) or you find a defect arises after delivery and a valid claim is received by Customer Service within 14days of delivery, nobetaway.com will exchange the product where possible, or refund you the purchase price of the product. Should you contact us outside the 14 day period ,customer service management will consider each claim on a case by case basis on its merits.
Where we agree to replace the product or refund you the purchase price of the Product, you must first return the defective product to us. You will be obliged to pay for the return of the product if the item is sent after 14 days from dispatch.
Replacement Products are provided with the balance of the warranty of the returned product.
Organising the return of DOA products
A customer should not return a DOA product withoout first notifying nobetaway.com of the problem and receiving an email to state that the goods can be returned
When a Replacement Product is arranged:
A replacement for the same product that you ordered will be shipped to you at our expense after we have received your returned Product.
When a refund is arranged:
Refunds include all shipping and associated costs for the DOA Product.
No refund will be given to you until we received the original product from the customer with all accessories and inclusions returned.
Refunds will be issued via a credit to your desired bank account or via your credit card.
WARRANTY:
Some Products sold through nobetaway.com are serviced and supported exclusively by their manufacturer in accordance the warranty information provided on the listing.
All watch warranties are covered by our international wholesale distributor ( not the manufacturer ). Should an issue occur with a watch , within the timeframe a noted on the watch listing, the watch is to be returned to our location in Perth for inspection. If the problem is deemed to be a manufacturer issue ( not a mistreatment issue ) the watch will be forwarded to our wholesaler for repair . The time frame for the return of a faulty watch to the customer is 3-4 weeks. If a watch is deemed to have been mistreated , we reserve the right to reject any warranty claim and request prepayment of return postage costs to the customer in question.
All mobile phones are covered by a 12 month return to base warranty. if any warrantable issue occurs within the first 12 months of ownership, the phone is to be returned to our location in Perth for servicing. The 12 month warranty on mobile phones does not cover issues with firmware, keypads, batteries, headphones and camera.
Goods returned to our location for servicing and deemed to have been altered or mistreated upon inspection, will not be serviced or repaired. We will notify the customer that we have determined the item to be altered or mistreated and that we will not service the returned item. We will also request the customer to forward return postage payment for items deemed to be mistreated or altered in any way, before we will retun the said item to the customer.
We do not issue warranty cards. your original receipt/ order confirmation is to be used as proof of purchase and to claim warranty within the timeframe as stated for the item ordered.
For items advertised and sold with manufacturer’s warranty, we would ask you to contact the manufacturer in the first instance for replacement or repair under the warranty terms.
Our Liability
We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Our maximum aggregate liability for any Product supplied to you whether in contract, or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
General
You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of nobetaway.com. Any unauthorized assignment shall be deemed null and void.
Under the Trade Practices Act 1974 ("Act"), where implied conditions and warranties cannot be excluded, any liability in nobetaway.com for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option nobetaplace.com , to the replacement of the Product(s) or the re-supply of the same Product(s); the payment of the cost of replacing the Product(s) or of acquiring equivalent Product(s).
Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.
We reserve the right to change the Terms and Conditions of sale at any time.
No employee or agent has the authority to vary any of the Terms and Conditions governing any sale.
We shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond our reasonable control , and nobetaplace.com shall be entitled to a reasonable extension of time for the performance of such obligations.
